WHAT IS PERSONAL DATA?

When we refer to personal data, we mean any information, of any nature and regardless of its medium, including sound and images, relating to an identified or identifiable natural person.

A person is considered identifiable if they can be identified directly or indirectly, in particular by reference to an identification number or to one or more factors specific to their physical, physiological, mental, economic, cultural or social identity.

WHO IS THE DATA CONTROLLER?

The entity responsible for the collection and processing of personal data is Bioplus, the company providing the service to you, which determines what data is collected, how it is processed, and for what purposes it is used.

WHAT KIND OF PERSONAL DATA DO WE COLLECT?

Bioplus, in the course of its business, collects and processes the personal data necessary for the provision of services and/or the supply of products, processing data such as name, address, telephone number and email address.

Without prejudice to compliance with legal provisions regarding the retention and transmission of data for the purposes of investigating, detecting and prosecuting serious crimes, Bioplus only processes traffic and location data necessary for its own activities.

Where there is prior consent from the Customer or User, which may be withdrawn at any time, Bioplus will process the relevant traffic and location data to the extent and for the duration necessary for the marketing and advertising of its services.

Information regarding your location may also be recorded and transmitted to legally authorized organizations upon request.

WHEN AND HOW DO WE COLLECT YOUR DATA?

Bioplus collects your data by telephone, in writing or via its website, subject to your consent. As a general rule, personal data is collected when you subscribe to one of our products or services, or via the forms available on the website.

Some personal data is mandatory, and if such data is missing or insufficient, Bioplus will be unable to provide the information in question.

HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

The period for which data is stored and retained varies depending on the purpose for which the information is processed.

In fact, there are legal requirements that oblige us to retain data for a minimum period of time.

Therefore, and whenever there is no specific legal requirement, the data will be stored and retained only for the minimum period necessary for the purposes that led to its collection or subsequent processing, or for the period authorised by the National Data Protection Commission, after which it will be deleted.

Bioplus may promote new products or services to its customers via telephone, email, SMS, MMS or any other electronic communications service, unless the customer has opted out at the time their data was collected.

If you do not wish to receive these communications, you may object at any time to the use of your data for marketing purposes, for the sending of informational communications or for inclusion in mailing lists or information services. To do so, you must send a written request to Bioplus.

WHAT MEASURES HAS Bioplus TAKEN TO ENSURE THE SECURITY OF YOUR PERSONAL DATA?

Bioplus is committed to ensuring the protection of the personal data provided to us. Compliance with these rules is an absolute obligation for all those who legally access such data.

Given the great concern and commitment Bioplus demonstrates in defending privacy issues, various technical and organizational security measures have been adopted to protect the personal data provided to us against its disclosure, loss, misuse, alteration, unauthorized processing or access, as well as against any other form of unlawful processing.

In this regard, our website and the forms used to collect personal data require encrypted browser sessions, and all personal data you provide to us is stored securely on Bioplus’s systems, which in turn are hosted on a server managed by Interage and protected by all the physical and logical security measures we consider essential for the protection of your personal data.

Notwithstanding the security measures adopted by Interage, we are obliged to advise all internet users to take additional security measures, namely: ensuring that you use a PC and browser that are up to date with security patches and properly configured, with an active firewall, antivirus and anti-spyware software; and verifying the authenticity of the websites you visit, whilst avoiding websites whose reputation you do not trust.

IN WHAT CIRCUMSTANCES IS DATA DISCLOSED TO OTHER ENTITIES (THIRD PARTIES AND SUBCONTRACTORS)?

Bioplus, within the scope of its activities, does not use third parties to provide services. Should this occur, Bioplus takes appropriate measures to ensure that the entities with access to the data are reputable and offer the highest standards of protection in this regard, which will be duly enshrined and safeguarded in a contract to be signed between Bioplus and the third-party entity or entities.

Consequently, any entity subcontracted by Bioplus will process our customers’ personal data on behalf of Bioplus, and is obliged to adopt the necessary technical and organisational measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, disclosure or unauthorised access, and against any other form of unlawful processing.

In any case, Bioplus remains responsible for the personal data you provide to us.

IN WHAT CIRCUMSTANCES DO WE TRANSFER YOUR PERSONAL DATA?

The provision of certain services by Bioplus may involve the transfer of your data outside Portugal.

In such cases, Bioplus will strictly comply with the applicable legal provisions, in particular regarding the assessment of the adequacy of that country in relation to the protection of personal data and the requirements applicable to such transfers.
